Foreign Ownership: Apartments Free, Land Restricted

Albania allows foreign nationals to own residential apartments and entire buildings on an equal footing with Albanian citizens (Law No. 7850), with no government approvals required. However, direct individual foreign ownership is restricted for two specific land categories: agricultural land, and land within the 200-metre coastal protection zone. These restrictions are typically navigated via an Albanian-incorporated company (sh.p.k., which can be 100% foreign-owned) or, in some cases, long-term leases of up to 99 years.

  • Apartments and buildings: 100% foreign ownership permitted, no permits required
  • Agricultural land: foreigners CANNOT buy directly as individuals -- use an Albanian sh.p.k. or 99-year lease
  • Coastal land within 200m of the shoreline: same restriction as agricultural -- sh.p.k. or lease structures required
  • A 3-year reciprocity-based exception exists for nationals of countries that grant equivalent rights to Albanians, but it is narrow and rarely used
  • No tax discrimination by nationality -- foreigners pay the same transfer tax, property tax, capital gains, and rental income tax as Albanians
  • Property ownership does NOT automatically grant residency -- a separate residence permit application is required
  • Pre-EU accession environment -- AML scrutiny on capital movements is strict, and source-of-funds documentation is essential
