Foreign Ownership Rights

Spain places no restrictions on foreign property ownership. EU citizens, EEA citizens, and third-country nationals can all purchase property freely, including agricultural land, commercial property, and residential real estate. No government approval or permits are required for residential purchase. A politically-proposed "non-EU non-resident buyer surcharge" (informally the "100% tax") was floated in early 2025 and reached draft in Parliament in May 2025 but has NOT been enacted as of May 2026.

  • No restrictions on foreign ownership — EU and non-EU citizens have equal property rights for residential purchase
  • No government approval or permits required for residential property
  • No minimum investment amount for property purchase
  • Agricultural land can be purchased by foreigners (though some autonomous communities require notification for large rural holdings)
  • No restriction on number of properties owned
  • Property ownership does NOT grant residency rights (separate visa required since April 2025)
  • Proposed non-EU buyer surcharge: in draft, not enacted — monitor for legislative updates if non-EU buyer
