Condominium Ownership (Permitted)

Foreigners can own condominium units on any floor of a building registered under the Apartment Ownership Law. This is the primary pathway for foreign property investment in Sri Lanka.

  • 100% foreign ownership of condominium units — no quota limits or caps
  • Available on any floor of the building (previous above-4th-floor restriction was removed)
  • The entire purchase price must be paid upfront via inward foreign remittance BEFORE the deed of transfer
  • Funds must be channelled through an Inward Investment Account (IIA) at a Sri Lankan bank
  • The IIA ensures repatriation rights for rental income and sale proceeds
  • No government approval required for condominium purchases
  • Unlike Thailand or Vietnam, Sri Lanka allows 100% foreign ownership without unit quotas

Land Ownership (Prohibited)

Since 2013, foreigners cannot purchase freehold land in Sri Lanka. Land can only be acquired on a 99-year lease or through a Sri Lankan company with majority local ownership.

  • Direct freehold land purchase by foreigners has been prohibited since 2013
  • Land can be leased for up to 99 years
  • Land owned or leased by foreigners cannot be mortgaged or pledged for 5 years from transfer/lease date
  • Foreigners can acquire land through a Sri Lankan company with 51%+ local ownership
  • The 15% land lease tax for foreigners was removed in 2017
  • These restrictions apply to bare land, houses, and villas on freehold land

Payment & Remittance Requirements

All foreign property purchases must be funded through inward foreign remittance via a designated Inward Investment Account (IIA). This is a strict regulatory requirement.

  • Full purchase price must be remitted from overseas BEFORE the deed of transfer
  • Funds must pass through an IIA at a licensed Sri Lankan bank
  • The IIA enables repatriation of rental income and sale proceeds
  • Local financing (mortgages) is NOT available to foreigners (only dual citizens and non-resident Sri Lankans qualify)
  • Proof of inward remittance is mandatory for registration
  • Currency: any major foreign currency, converted to LKR at prevailing rates
