Foreign Ownership Rules

  • No restrictions, no surcharge: A non-resident may hold South African property in freehold on identical terms to a citizen — no permit, no quota, and none of the foreign-buyer surcharges levied in the United Kingdom, Singapore, Canada or Australia. There is no non-resident premium to pay on the purchase price at all. The only categorical exclusion is agricultural land in certain circumstances.
  • The real constraint is finance, not title: Exchange Control Regulation 3(1)(f) prohibits credit to a non-resident without SARB approval, and Authorised Dealers implement it as a hard 50% loan-to-value ceiling — one rand introduced from offshore for every rand borrowed locally. Budget for half the price in cash. This is the single most consequential rule for a foreign buyer and is the default in every calculator above.
  • Deeds Office registration: Title passes on registration in the Deeds Office under the Deeds Registries Act 47 of 1937 — not on signature of the sale agreement. Registration typically runs 8–12 weeks. The conveyancer is nominated by the seller, not the buyer, which surprises buyers from markets where each side instructs its own lawyer.
  • Bring the money in properly: Deposit funds must be remitted through an Authorised Dealer and recorded as an introduced foreign investment. Funds brought in this way are freely repatriable on sale; funds that were not can be difficult to take out again. FICA source-of-funds verification is the usual cause of delay for foreign buyers — not the conveyancing itself.
  • Sectional title and estates: Apartments and most secure-estate homes are held as sectional title under the Sectional Titles Act 95 of 1986: you own your section plus an undivided share of common property, and pay a monthly body corporate levy on top of municipal rates. The levy is not a tax and is not in the figures above — ask for the scheme's financials before committing.

Residency & Currency Risk

South Africa does not operate a Golden Visa programme. Buying property grants no residency, work rights or right of entry. Ownership and immigration are entirely separate questions here, and a buyer who needs to live in the property must qualify independently under the Immigration Act 13 of 2002:

  • Financially Independent Permit: Permanent residence for applicants who can demonstrate net worth of at least R12m and pay a once-off, non-refundable Home Affairs fee of R120,000 on issue. The R12m need only be PROVEN to exist — it does not have to be transferred into South Africa — and property counts toward the test. It remains a wealth test, not a property-purchase programme, and processing runs to roughly 24 months.
  • Retired Person's Visa: Renewable temporary residence on proof of a pension or annuity of at least R37,000 per month, with no minimum age. Popular with Garden Route and Winelands buyers.
  • Business or Critical Skills: A business visa requires a capital contribution of R5m and job-creation undertakings; the Critical Skills route depends on the published occupations list. Neither is satisfied by a property purchase.
  • Visitor's status: Many nationalities receive 90 days visa-free, which is sufficient for a holiday-home owner. Ownership does not extend this and does not create a right of return.
  • Currency is the dominant risk: The rand is among the most volatile emerging-market currencies. SA house prices have grown below CPI for most of the past decade, so the nominal growth figures above are close to flat in real terms — and for an offshore buyer, the ZAR exchange rate will usually matter more to the outcome than anything about the property. Treat the yield as the return and the capital growth as uncertain.
  • Practical due diligence: Confirm the municipal rates clearance certificate, the body corporate's financial position, and — outside the metros — the security of water and electricity supply. Load-shedding has eased since 2024 but backup provision still affects both value and running cost.
